Please read these Terms of Service ("Terms") carefully before using the ZodAI mobile application ("App") operated by Rico Schurter ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

ZODAI IS PROVIDED SOLELY FOR ENTERTAINMENT AND PERSONAL INSIGHT PURPOSES. ZodAI is intended solely for adults. You must be at least 18 years of age to create an account or use ZodAI. ZodAI is not directed to, and we do not knowingly permit use by or collect personal data from, anyone under 18.
The App enforces this at registration using your date of birth: if your date of birth indicates you are under 18, your account will not be created and no personal data will be stored. By using ZodAI, you represent and warrant that you are at least 18 years of age.
ZodAI offers the following premium plans, sold as in-app purchases through the Apple App Store and Google Play:

Prices are in US Dollars and may vary by country as determined by Apple or Google, shown in your local currency. Applicable taxes may be added. The price and plan displayed to you at the time of purchase govern the transaction.
New subscribers may be eligible for a 7-day free trial before their first billing period. Conditions:
MONTHLY AND ANNUAL SUBSCRIPTIONS AUTOMATICALLY RENEW UNLESS AUTO-RENEWAL IS TURNED OFF AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT PERIOD. YOUR ACCOUNT WILL BE CHARGED FOR RENEWAL WITHIN 24 HOURS PRIOR TO THE END OF THE CURRENT PERIOD AT THE THEN-CURRENT SUBSCRIPTION RATE. A FREE TRIAL AUTOMATICALLY CONVERTS INTO A PAID SUBSCRIPTION UNLESS CANCELLED BEFORE IT ENDS. THE LIFETIME PLAN IS A ONE-TIME PURCHASE AND DOES NOT RENEW.
You can view, manage, and cancel your subscription at any time in your Apple App Store or Google Play account settings, or in-app via Profile → Manage Subscription. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused subscription time, except as required by Apple's or Google's policies or by applicable law.
All purchases are processed by Apple or Google. Refund requests must be submitted to them: Apple at reportaproblem.apple.com; Google through the Google Play Store. Your statutory refund and consumer rights (including the EU right below) are not affected.
If you are a consumer in the EEA or the UK, you normally have 14 days to withdraw from a purchase of digital services. However, by starting to use a paid feature (or a free trial that gives immediate access) during that period, you expressly request that we begin providing the service immediately and you acknowledge that you lose your right of withdrawal once the service has been fully performed. This reflects Article 16(m) of the EU Consumer Rights Directive (as implemented in national law, including the Italian Consumer Code) and equivalent UK rules. This does not limit any other mandatory consumer right you have.

We reserve the right to suspend or terminate accounts that violate these restrictions.
All content, design, code, trademarks, logos, AI prompts, and interfaces of ZodAI are the exclusive property of Rico Schurter or our licensors. Nothing in these Terms grants you any ownership or license except the limited right to use the App for personal, non-commercial purposes.
You may not copy, reproduce, modify, distribute, display, or sublicense any part of ZodAI without our prior written permission.
You retain ownership of the personal information you provide (name, birth data, messages). By submitting content to ZodAI, you grant us a limited, non-exclusive, royalty-free license to process that content solely to provide the App's services to you. We do not use your messages or birth data to train AI models.
When you enter another person's birth details to generate a compatibility reading, you represent and warrant that you have the authority or consent to provide that information; and if that person is a minor, that you are their parent or legal guardian. If you or a third party wishes to have such data removed, contact privacy@zodai.io and we will act on the request. See our Privacy Policy for full details.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. ASTROLOGICAL CONTENT HAS NO SCIENTIFIC BASIS FOR PREDICTING FUTURE EVENTS, PERSONALITY TRAITS, OR LIFE OUTCOMES.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you, and you may have additional mandatory consumer rights.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RICO SCHURTER AND ZODAI ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO ZODAI IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.00 USD.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or your mandatory consumer rights. If you are a consumer in the EEA, the UK, or Switzerland, these limitations apply only to the extent permitted by the mandatory law of your country.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Rico Schurter and ZodAI from any claims, liabilities, damages, costs, and fees (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the App in an unauthorized manner, your submission of another person's data without the required authority or consent, or your violation of any third party's rights or applicable law. This does not apply to the extent a claim results from our own wrongdoing, and does not affect your mandatory consumer rights.
Before initiating formal proceedings, contact us at support@zodai.io with a written description of the dispute. We will attempt to resolve it within 30 days.
For users located in the United States: if informal resolution fails, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Either party may bring an individual claim in small-claims court.
US USERS WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS OR REPRESENTATIVE PROCEEDINGS. ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY.
You may opt out of arbitration by emailing support@zodai.io within 30 days of first using ZodAI with the subject "Arbitration Opt-Out."
Sections 14.2–14.4 do not apply to consumers in the EEA, the UK, or Switzerland. If you are a consumer, nothing in these Terms deprives you of the mandatory protections of the law of your country of habitual residence, and you may bring proceedings in the courts of that country. In particular, consumers resident in Italy may bring proceedings before the court of their place of residence or domicile, in accordance with Art. 66-bis of the Italian Consumer Code. EU/EEA consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
To the extent permitted by law, any claim must be filed within one (1) year of the date the claim arose, except where prohibited by applicable law (including mandatory consumer time limits in your country).
These Terms are governed by the laws of Switzerland, without regard to conflict of law provisions. For non-consumer and non-arbitrated matters, the exclusive jurisdiction shall be the courts of Bellinzona, Canton Ticino, Switzerland.
If you are a consumer, you also benefit from the mandatory consumer-protection law and courts of your country of residence, as described in Section 14.5 (including Art. 66-bis of the Italian Consumer Code for consumers in Italy). The UN Convention on Contracts for the International Sale of Goods does not apply.
If you download the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App. Refunds and subscription management for Google Play purchases are handled through Google Play.
You may delete your account at any time via Profile → Delete Account. Deletion is permanent and immediate. Cancel active subscriptions separately through Apple or Google to avoid continued billing.
We may suspend or terminate your access for violation of these Terms, fraudulent or illegal behavior, or misuse of the App. No refund will be provided upon termination for cause, except as required by applicable law.
Upon termination, your right to use the App ceases. Sections covering the entertainment disclaimer, AI disclosure, intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.
When we make material changes, we will update the "Last updated" date and notify you via email or in-app notification at least 15 days before changes take effect. Continued use after the effective date constitutes acceptance.

Puoi visualizzare, gestire e cancellare l'abbonamento in qualsiasi momento nelle impostazioni del tuo account App Store di Apple o Google Play, o in-app tramite Profilo → Gestisci abbonamento. Se sei un consumatore nel SEE o nel Regno Unito, hai normalmente 14 giorni per recedere dall'acquisto di servizi digitali. Nulla nei presenti Termini ti concede alcuna proprietà o licenza, salvo il diritto limitato di usare l'App per finalità personali e non commerciali.
Non puoi copiare, riprodurre, modificare, distribuire, mostrare o concedere in sublicenza alcuna parte di ZodAI senza il nostro previo permesso scritto.
Mantieni la proprietà dei dati personali che fornisci (nome, dati di nascita, messaggi). Inviando contenuti a ZodAI, ci concedi una licenza limitata, non esclusiva e a titolo gratuito per trattare tali contenuti al solo fine di fornirti i servizi dell'App. Non usiamo i tuoi messaggi o dati di nascita per addestrare modelli AI.
Quando inserisci i dati di nascita di un'altra persona per generare una lettura di compatibilità, dichiari e garantisci di avere l'autorità o il consenso per fornire tali informazioni; e, se quella persona è un minore, di esserne genitore o tutore legale. Se tu o un terzo desiderate la rimozione di tali dati, scrivi a privacy@zodai.io e daremo seguito alla richiesta. Vedi la nostra Informativa sulla privacy per i dettagli.
L'APP È FORNITA "COSÌ COM'È" E "COME DISPONIBILE", SENZA GARANZIE DI ALCUN TIPO, ESPRESSE O IMPLICITE, INCLUSE LE GARANZIE DI COMMERCIABILITÀ, IDONEITÀ A UNO SCOPO PARTICOLARE, ACCURATEZZA E NON VIOLAZIONE. NON GARANTIAMO CHE L'APP SARÀ ININTERROTTA, PRIVA DI ERRORI O SICURA, NÉ CHE EVENTUALI DIFETTI SARANNO CORRETTI. I CONTENUTI ASTROLOGICI NON HANNO BASE SCIENTIFICA PER PREVEDERE EVENTI FUTURI, TRATTI DI PERSONALITÀ O RISULTATI DI VITA.
Alcune giurisdizioni non consentono l'esclusione di determinate garanzie, pertanto alcune delle esclusioni sopra potrebbero non applicarsi a te, e potresti avere ulteriori diritti imperativi di consumatore.
NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, RICO SCHURTER E ZODAI NON SONO RESPONSABILI PER DANNI INDIRETTI, INCIDENTALI, SPECIALI, CONSEQUENZIALI O PUNITIVI DERIVANTI DAL TUO USO O DALLA TUA IMPOSSIBILITÀ DI USARE L'APP, ANCHE SE AVVISATI DELLA POSSIBILITÀ DI TALI DANNI.
LA NOSTRA RESPONSABILITÀ TOTALE PER QUALSIASI PRETESA RELATIVA AI PRESENTI TERMINI O ALL'APP NON SUPERERÀ IL MAGGIORE TRA: (A) L'IMPORTO TOTALE VERSATO A ZODAI NEI 12 MESI PRECEDENTI LA PRETESA, O (B) 100,00 USD.
Nulla nei presenti Termini esclude o limita la responsabilità che non può essere esclusa o limitata dalla legge applicabile, inclusa la responsabilità per morte o lesioni personali causate da negligenza, per dolo o frode, o i tuoi diritti imperativi di consumatore. Se sei un consumatore nel SEE, nel Regno Unito o in Svizzera, queste limitazioni si applicano solo nella misura consentita dalla legge imperativa del tuo Paese.
Nella misura consentita dalla legge, accetti di difendere, manlevare e tenere indenne Rico Schurter e ZodAI da qualsiasi pretesa, responsabilità, danno, costo e onere (incluse ragionevoli spese legali) derivante dalla tua violazione dei presenti Termini, dal tuo uso non autorizzato dell'App, dalla tua immissione dei dati di un'altra persona senza l'autorità o il consenso richiesti, o dalla tua violazione dei diritti di terzi o della legge applicabile. Ciò non si applica nella misura in cui una pretesa derivi da un nostro illecito, e non pregiudica i tuoi diritti imperativi di consumatore.
Prima di avviare procedimenti formali, contattaci a support@zodai.io con una descrizione scritta della controversia. Cercheremo di risolverla entro 30 giorni.
Per gli utenti negli Stati Uniti: se la risoluzione informale fallisce, le controversie saranno risolte tramite arbitrato individuale vincolante amministrato dall'American Arbitration Association (AAA) secondo le sue Consumer Arbitration Rules. Ciascuna parte può proporre una domanda individuale davanti a un giudice per le controversie di modico valore.
GLI UTENTI USA RINUNCIANO AL DIRITTO DI PARTECIPARE AD AZIONI COLLETTIVE O RAPPRESENTATIVE. TUTTE LE PRETESE DEVONO ESSERE FATTE VALERE SU BASE INDIVIDUALE.
Puoi rinunciare all'arbitrato scrivendo a support@zodai.io entro 30 giorni dal primo uso di ZodAI, con oggetto "Arbitration Opt-Out".
Le sezioni 14.2–14.4 non si applicano ai consumatori nel SEE, nel Regno Unito o in Svizzera. Se sei un consumatore, nulla nei presenti Termini ti priva delle tutele imperative della legge del tuo Paese di residenza abituale, e puoi agire dinanzi ai giudici di tale Paese. In particolare, i consumatori residenti in Italia possono agire dinanzi al giudice del luogo di residenza o domicilio, ai sensi dell'art. 66-bis del Codice del Consumo. I consumatori del SEE possono inoltre usare la piattaforma UE di risoluzione delle controversie online su ec.europa.eu/consumers/odr.
Nella misura consentita dalla legge, qualsiasi pretesa deve essere proposta entro un (1) anno dalla data in cui è sorta, salvo ove vietato dalla legge applicabile (inclusi i termini imperativi a tutela del consumatore del tuo Paese).
I presenti Termini sono regolati dalla legge svizzera, senza riguardo alle norme sui conflitti di legge. Per le controversie non riguardanti consumatori e non arbitrate, il foro esclusivo è quello di Bellinzona, Canton Ticino, Svizzera.
Se sei un consumatore, benefici anche della legge imperativa a tutela dei consumatori e dei giudici del tuo Paese di residenza, come descritto nella Sezione 14.5 (incluso l'art. 66-bis del Codice del Consumo per i consumatori in Italia). La Convenzione delle Nazioni Unite sui contratti di vendita internazionale di beni non si applica.
Se scarichi l'App da Google Play, il tuo uso è soggetto anche ai Termini di servizio di Google Play. Google non è parte dei presenti Termini e non è responsabile dell'App. I rimborsi e la gestione degli abbonamenti per gli acquisti su Google Play sono gestiti tramite Google Play.
Puoi cancellare il tuo account in qualsiasi momento tramite Profilo → Cancella account. La cancellazione è permanente e immediata. Cancella separatamente gli abbonamenti attivi tramite Apple o Google per evitare ulteriori addebiti.
Possiamo sospendere o chiudere il tuo accesso in caso di violazione dei presenti Termini, comportamenti fraudolenti o illegali, o uso improprio dell'App. Nessun rimborso è previsto in caso di risoluzione per giusta causa, salvo quanto richiesto dalla legge applicabile.
Alla risoluzione, il tuo diritto di usare l'App cessa. Le sezioni relative all'avviso di intrattenimento, all'informativa AI, alla proprietà intellettuale, alle esclusioni di garanzia, alla limitazione di responsabilità e alla risoluzione delle controversie sopravvivono alla cessazione.
In caso di modifiche sostanziali, aggiorneremo la data "Ultimo aggiornamento" e ti avviseremo via email o notifica in-app almeno 15 giorni prima che le modifiche abbiano effetto. L'uso continuato dopo la data di efficacia costituisce accettazione.
